Welcome to Pixies Brew! The terms “we”, “us”, and “our” refer to Pixies Brew. We operate this store and website (the “Site”), including all related information, content, features, tools, products, and services (collectively, the “Services”) to provide you with a curated shopping experience. Pixies Brew is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”) outline your rights and responsibilities when using our Services. By visiting, interacting with, or purchasing from Pixies Brew, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not access or use our Services.
1. Eligibility and Account
You represent that you are at least the age of majority in your jurisdiction and, if applicable, have given consent for any minor dependents to use the Services on your devices.
When creating an account or making a purchase, you agree to provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and all activity under your account. You may not transfer or assign your account to another party.
2. Products and Descriptions
We make every effort to display our products accurately. However, variations may occur due to screen settings, natural differences in coffee harvests, or roasting processes. Flavor descriptions are guides and may vary slightly from batch to batch.
We do not guarantee that any product or service will meet your expectations. We reserve the right to modify or discontinue products, change pricing, or limit quantities at any time without notice.
3. Orders and Payment
Placing an order constitutes an offer to purchase. Pixies Brew reserves the right to accept or decline any order. Orders are accepted only once payment has been processed and confirmed.
Please review your order carefully before submitting, as cancellations or changes may not be accommodated once an order is accepted. If your order cannot be fulfilled, we will contact you via the email or phone number provided.
All purchases are subject to our Refund Policy. Coffee and sample packs are final sale. You agree that purchases are for personal use only and not for resale.
4. Pricing and Billing
Prices and promotions are subject to change without notice. Posted prices do not include taxes, shipping, or handling fees unless stated otherwise.
You agree to provide valid and current payment information and authorize us to charge your payment method for all purchases. You represent that you are authorized to use the payment method provided and will update your details as needed.
5. Shipping and Delivery
We currently ship within the United States only.
All orders include tracking and optional shipping protection for lost or damaged items. Risk of loss transfers to you once the carrier accepts your shipment. Pixies Brew is not responsible for delays, customs processing, or delivery issues once a package is marked as “delivered.”
Delivery times are estimates only and not guaranteed.
6. Intellectual Property
All content on the Services — including text, images, graphics, videos, product designs, and trademarks — belongs to Pixies Brew or its licensors and is protected by U.S. and international laws.
You may not copy, reproduce, or distribute any part of the Services without prior written consent. Unauthorized use may violate intellectual property laws.
Pixies Brew trademarks, names, and logos may not be used without permission. Shopify’s trademarks are the property of Shopify Inc.
7. Third-Party Tools and Links
Our Services may provide access to tools or links operated by third parties. Such tools and sites are provided “as is” without warranties or endorsements. Pixies Brew is not responsible for third-party content, functionality, or services. Please review third-party policies before engaging with them.
8. Relationship with Shopify
Pixies Brew is powered by Shopify. However, all purchases are made directly with Pixies Brew. Shopify is not responsible for any aspect of sales or fulfillment. You release Shopify and its affiliates from all claims arising out of your use of our Services or your purchases.
9. Privacy
Your personal information is handled in accordance with our Privacy Policy and Shopify’s Privacy Policy. Both explain how your data may be collected, used, or shared in connection with our Services. By using the Services, you consent to such processing.
10. Mobile Messaging Terms
By opting into Pixies Brew’s SMS/text messaging service (the “Mobile Service”), you consent to receive recurring text messages (including marketing and cart reminders) from or on behalf of Pixies Brew at the mobile number you provided.
Text messages may be sent via an automated system. Your consent to receive texts is not a condition of any purchase. Message frequency may vary. Message and data rates may apply.
You may opt out at any time by texting STOP to +1 (855) 560-1259 or clicking the unsubscribe link in a message. You’ll receive one final confirmation text. For help, text HELP to the same number or email hello@pixiesbrew.com.
We may change the phone number or short code used for the Service. Wireless carriers are not liable for delayed or undelivered messages. You agree to provide an accurate mobile number and update it if it changes.
We are not responsible for any failed, delayed, or misdirected messages or your reliance on information sent via text. Please see our Privacy Policy for how we collect and use personal data in connection with the Mobile Service.
11. Feedback
If you provide us with ideas, suggestions, or feedback (“Feedback”), you grant Pixies Brew a perpetual, royalty-free license to use and share that Feedback for any purpose, including commercial use, without obligation to compensate you.
12. Errors and Corrections
We reserve the right to correct any errors, inaccuracies, or omissions and to update or cancel orders if any information is inaccurate, including after an order is placed.
13. Prohibited Uses
You agree not to use our Services for unlawful, harmful, or abusive purposes. This includes, but is not limited to, hacking, spamming, data scraping, impersonation, or interfering with site operations. Violations may result in termination of your access without notice.

These Terms are governed by the laws of the state in which Pixies Brew is headquartered, without regard to conflict-of-law principles. You consent to the jurisdiction of local and federal courts in that state.

We may update these Terms from time to time. The latest version will always be posted on this page with the effective date. Your continued use of the Services after updates constitutes acceptance of the revised Terms.
